Answer in brief

Ability, finances and the hajj queue

Is it permissible for an employee to perform Hajj secretly without the employer's approval, when the employment contract prohibits performing Hajj during working duty?

Answer in brief

This fatwa holds that an employee may not perform Hajj in breach of his contract. Hajj is not obligatory on him at that time because he falls under the category of lacking capability (istitaah), and to avoid harm such as legal action. However, if he has already performed Hajj fulfilling its obligatory conditions and pillars, the Hajj is valid and his obligation is discharged. Breaching the contract and trust remains forbidden and sinful, so he is advised to abide by the agreement he signed.
