Answer in brief

Ihram and miqat

If someone makes the intention of ihram at home, even though he will not perform umrah or hajj any time soon, is he considered to be in ihram and bound by its prohibitions?

Answer in brief

The intention of ihram should be made at the miqat or before crossing it. The Shafi'i school holds two views: one says it is better to enter ihram at the miqat, the other permits making the intention in one's own country. This fatwa prefers the first view, so making the intention at home goes against the Prophet's practice, yet the ihram remains valid and the person is bound by its prohibitions. The intention for hajj must also be made within the hajj months of Shawwal, Dhul Qadah and Dhul Hijjah.

Perbuatan berniat ihram di negeri sendiri tidaklah tidak sah ihramnya akan tetapi ianya menyalahi sunnah Nabi. Ianya tetap sah dan terikat dengan larangan-larangan ketika berihram.
