Answer in brief

Dam and fidyah (expiation)

Is a pilgrim in ihram required to pay a dam if hair falls out but he is unsure whether more than three strands fell or whether it fell because of his own action?

Answer in brief

A person in ihram does not owe a dam or fidyah if he is uncertain whether the fallen hair is his own, or whether it fell by itself or through his own action. This rests on the principle that a person is originally free from liability. A dam is due only when he is certain the hair is his and that it fell as a result of his own act, such as rubbing his head while bathing. For three or more strands removed at one time and place, the dam is fasting for three days, feeding six poor people or slaughtering a goat.
