Tawaf
Does accidental touching between a man and a woman during tawaf invalidate wudu, and is the tawaf still valid?
Answer in brief
Wudu is a condition for a valid tawaf. The preferred view in the Shafi'i school holds that skin contact between a man and a woman without a barrier breaks wudu, while the Hanafi school holds that it does not, and the well-known Hanbali and Maliki view is that it does not break wudu if there is no desire. This fatwa follows the 21st Hajj Muzakarah, which permits adopting the weaker Shafi'i opinion that wudu remains valid when contact occurs without desire in situations of hardship such as crowding during tawaf. The wudu is therefore not invalidated and the tawaf remains valid.
