Ihram and miqat
Is it valid for a woman in menstruation to make a conditional intention for umrah at the miqat?
Answer in brief
Menstruation, postpartum bleeding and major ritual impurity do not prevent a person from making the intention of ihram for hajj or umrah. Ritual purity is required only during prayer and tawaf. A conditional intention is permitted based on the hadith of Dhuba'ah bint al-Zubair, whereby a person in ihram may stipulate that they will exit ihram if illness or an obstacle occurs. When the condition is met, the person exits ihram with the intention and by shaving or trimming the hair, and no dam is due unless the stipulation included a dam.
